Many Sutherland Shire pergolas can be exempt from approval if they meet every Codes SEPP standard, including no more than 25m² and 3 metres high, at least 900mm from each boundary, and behind the building line. On waterfront blocks, check the foreshore building line, and on bushfire-prone land a pergola within 5 metres of the house must be non-combustible.
Exempt pergolas: the checklist
Sutherland Shire Council is the council for the whole Shire. A pergola that meets every standard in the state Codes SEPP needs no council approval. If it misses even one, you need a complying development certificate (CDC) or a development application (DA).
| Standard | Exempt if | Shire catch |
|---|---|---|
| Area | No more than 25m² | Big alfresco pergolas go over |
| Height | No more than 3 m at the highest point | Raised gable roofs |
| Setbacks | At least 900mm from each boundary | Narrow lots in Cronulla and Caringbah |
| Position | Behind the building line | Corner blocks have two frontages |
| Roofed and attached | No part above the house gutter line | Low eaves on single-storey brick homes |
| Bushfire-prone land | Non-combustible if within 5 m of the house | Engadine, Heathcote, Grays Point, Bundeena |

Waterfront blocks and bushland edges
Homes on Port Hacking, Gunnamatta Bay, the Woronora River and the Georges River often have a foreshore building line on the planning maps. Sutherland Shire Local Environmental Plan 2015 limits development in the foreshore area, and state exempt rules restrict structures such as pergolas forward of that line. A pergola by the water may need a DA, or may not be allowed where you want it.
Suburbs that back onto the Royal National Park and Heathcote National Park, such as Engadine, Heathcote, Grays Point, Bundeena and parts of Jannali, include land mapped as bushfire-prone. An exempt pergola there must be non-combustible if it is within 5 metres of the house, which usually means steel or aluminium rather than timber.
Check your block first. A Section 10.7 certificate from Sutherland Shire Council, or the NSW Planning Portal's spatial viewer, shows foreshore building lines, bushfire-prone land and other limits for your address.
Coastal wind, salt and the right materials
Cronulla, Wanda, Kurnell and Bundeena are exposed to salt spray and strong southerly winds. That affects both how a pergola is held down and what it is made of.
- Roofed pergolas catch wind like a sail. Ask the builder about the engineering for footings, tie-downs and the fascia connection. The exempt rules require any connection to a fascia to follow an engineer's specifications.
- Near the beach, choose powder-coated aluminium or steel with a coating rated for coastal exposure, and stainless fixings.
- Timber pergolas look warm but need regular oiling or painting in salt and sun.
- Roof water from a roofed pergola must drain into the existing stormwater system.
- Opening louvre roofs count as roofed structures, so they must meet the roofed rules.
What to tell the crew when you ask for quotes
Give the rough size and height, and say whether you want an open pergola, a fixed roof or louvres. Say whether it attaches to the house or stands free, and how high your gutters are. Mention whether you are on the waterfront, on bushfire-prone land, or close to the beach. Add photos of the area and the back of the house.

Common questions
Do I need council approval for a pergola in the Sutherland Shire?
Not if it meets every exempt standard in the Codes SEPP, such as no more than 25m², no more than 3 metres high, at least 900mm from each boundary and behind the building line. If it misses any standard, or your land is excluded, you need a CDC or a DA. Sutherland Shire Council or a certifier can confirm.
Can I build a pergola on my waterfront block?
Possibly, but check the foreshore building line first. Sutherland Shire's planning rules limit development in the foreshore area, and the state exempt rules restrict pergolas forward of that line. A Section 10.7 certificate shows whether a foreshore building line applies, and council can tell you what is allowed.
What pergola materials suit bushfire-prone land?
If the pergola is within 5 metres of the house and you want it to be exempt, it must be built of non-combustible material. That usually means steel or aluminium, with a metal or other non-combustible roof. Further from the house, or with approval, other options may be possible. Ask the builder to confirm in writing.
Is a louvre roof pergola exempt?
It can be, but it counts as a roofed structure. If it is attached to the house, no part can sit above the gutter line, any fascia connection must follow an engineer's specifications, and roof water must go into the existing stormwater system. It must also meet the general size, height and setback rules.
